EU advice sought on Kit Kat ruling

A UK judge deliberating on a legal dispute relating to the shape of a Kit Kat has decided to have a break - and wait for a decision from a European court.

Justice Richard Arnold is analysing a High Court argument between confectionery giants Nestle - which sells Kit Kat bars - and Cadbury.

Nestle wants to register the three-dimensional shape of a Kit Kat as a trademark. Cadbury has objected.

The judge heard legal argument from both sides at a hearing in London in December - and outlined his thoughts in a published ruling.

He said aspects of European trademark law were "unclear". And he said he would seek clarification from the Court of Justice in the European Union.

"Certain aspects of the relevant law remain unclear," said Justice Arnold.

"I have decided it is necessary to seek clarification of the law from the Court of Justice of the European Union in order to determine the (dispute)."

GE profit rises five per cent in 4Q

GENERAL Electric Co says its net income rose five per cent in the fourth quarter on rising profits from the sale of aircraft engines, oil and gas drilling equipment and appliances.

Its adjusted earnings matched Wall Street expectations.

Its shares edged higher in premarket trading.

GE reported net income of $US4.2 billion ($A4.7 billion) for the fourth quarter of 2013 on revenue of $US40.38 billion.

That's up from net income of $US4.01 billion on revenue of $US39.16 billion in the fourth quarter of 2012.

Adjusted to remove the effects of one-time items and discontinued operations, GE earned 53 cents per share.

That matches what analysts polled by FactSet expected, on average.

GE's adjusted earnings per share rose 20 per cent compared with the prior quarter.

Profit in the company's aviation, oil and gas, and appliances divisions all rose 20 per cent or more in the quarter.

Girl, 4, fatally shoots boy at US home

A FOUR-YEAR-OLD girl has accidentally shot and killed her four-year-old cousin with a rifle she found under a bed at their grandfather's US home.

The girl was playing and watching TV on Thursday with the boy when she found the gun, Detroit police Sergeant Michael Woody said.

He said she pointed it at the boy and shot him once in the chest.

The boy was taken to a hospital, where he was pronounced dead.

An adult family friend was at the home with the children at the time, Woody said.

It wasn't immediately known who owns the gun.

The Wayne County prosecutor's office will determine whether charges should be brought, Woody said.

"It's a tragic incident," Woody told The Associated Press.

"It's really not anything more than that. There was no malicious intent. There was nothing there to suggest that the grandfather put those children in harm's way, but the investigation will continue."

The boy's name wasn't immediately released.

Woody said the shooting reinforces the need for those with guns to keep them secure.

"This is a very senseless ... incident that could have been avoided," he said.

Unemployment tipped to hold steady in Dec

AUSTRALIA'S jobless rate is tipped to remain steady in December, amid expectations the housing market recovery will create jobs.

Unemployment is forecast to remain at 5.8 per cent when labour force figures for December are released on Thursday, according to an AAP survey of 14 economists.

The number of people with jobs is forecast to rise by 5,000 while the participation rate - the percentage of the working-age population either in work or looking for a job - is expected to remain steady at 64.8 per cent.

HSBC chief economist Paul Bloxham said the pickup in housing as well as retail sales would begin to flow through to job creation, curbing the unemployment rate before it reaches six per cent.

"We think the rebalancing of the Australian economy is happening very slowly but we do think it is happening and we think that's going to start showing up in the labour market sometime fairly soon," Mr Bloxham said.

But JP Morgan chief economist Stephen Walters said job creation in retail and housing wouldn't be enough to stop the unemployment rate from drifting above six per cent.

JP Morgan forecasts that unemployment will reach 6.5 per cent by mid-year.

"We do think there will be job creation in those sectors but just not enough to absorb the new entrants into the labour force," Mr Walters said.

Bank of America 4Q earnings jump

BANK of America Corp says its fourth-quarter profit jumped from a year earlier, as the loans on the bank's balance sheet continued to improve.

The second-largest US bank says it earned $US3.44 billion ($A3.85 billion) in the October-to-December period, up from $US732 million a year earlier.

On a per-share basis, the bank made 29 cents, beating the 27 cents expected by financial analysts.

Profits got a big boost because Bank of America was able to significantly reduce the amount of money it holds on its balance sheet to protect itself from bad loans.

Fourth-quarter revenue rose to $US22.32 billion from $US19.6 billion, exceeding analysts' forecasts of $21.2 billion.

Bank of America was up two per cent in pre-market trading.

Queen collects plethora of gifts

FABULOUS jewels, sumptuous decorative pieces, fine wine and an Oyster travel smartcard are just some of the official gifts received by the Queen last year.

As a token of thanks the Queen received a plethora of presents during royal engagements in 2013.

When the head of state marked the 150th anniversary of London Underground by visiting the capital's Baker Street Tube station last March, she was presented with a commemorative Oyster card, as were the Duke of Edinburgh and Duchess of Cambridge.

And when Sheikh Khalifa bin Zayed, president of the United Arab Emirates, arrived for a state visit last April, he brought for his host a gold jewelled frame set on a jewelled ostrich egg.

He also gave the Queen a five-strand necklace, made from natural pearls sourced from the Arabian Gulf.

The more unusual gifts included an edible carriage - a replica of the Irish state coach - made from chocolate, sugar and 24-carat gold leaf.

It was presented in April at the end of a royal visit to the UK headquarters of the firm Mars.

The item was included in a list of officials gifts given to members of the Royal Family and released by Buckingham Palace.

One of the presents given to the Princess Royal was a contemporary art print of Anne riding a moose - handed over by its creator artist Charles Pachter.

The presentation was made during the Princess' tour of Canada last October, and came the day Prince George was christened.

Charles was also presented with a ceramic figurine of himself with children's character Postman Pat while in Jordan.

The gift came from the Jordan-based firm Rubicon which is making an animated film about Pat, due for release this year, in partnership with the Hollywood studio Dreamworks.

University main round offers released

ABOUT 86,000 aspiring university students across NSW and the ACT are about to discover if their chosen institution has offered them a position.

But with universities only making 50,814 offers in the main round, there is bound to be some who are disappointed.

From 9pm (AEDT) on Thursday applicants will be able to log online and find out if they have been made an offer.

University Admissions Centre director Kim Paino said there were 4990 less main round offers than last year.

"While less offers have been made in the main round this year compared to last year, the total pool of offers has increased," she said.

"Many universities have increased their number of offers by making additional offers in the early rounds before main round."

For those who do not receive a main round offer, there are several later rounds.

The next round is on January 30.

The names of successful applicants will also be published in News Corp Australia and Fairfax Media papers on Friday.

SA bracing for heat and fires

SCORCHING temperatures and an extreme bushfire risk are in store for Adelaide and much of South Australia on Thursday.

The city could post a temperature record, with a 46C peak forecast, close to 46.1C in 1939.

Adelaide is expected to have a top of 40C on Friday, before a cool change sweeps across SA, ending a five-day heatwave, the third worst in the state's history.

The hot weather and increasing winds are causing concern for the Country Fire Service (CFS), with fears that conditions could spark major incidents.

The CFS has been fighting a string of fires in the Adelaide Hills, the mid-north, the southeast and across Eyre Peninsula.

Those causing the most concern on Wednesday were at Delamere, south of Adelaide, at Ngarkat in the southeast, at Kiana on Eyre Peninsula and at Rockleigh, east of the city.

An extra five water-bombing aircraft will arrive in the state on Thursday to bolster local resources.

The State Emergency Service (SES) urged people to continue to be vigilant to protect themselves and others as best they can from the extreme conditions.

SES spokesman Scott Turner said people should "look after each other, look after the community and survive until we see some reprieve".

JPMorgan returns to a profit in Q4

JPMORGAN Chase, the biggest US bank by assets, says it returned to a profit in the fourth quarter.

The bank said it had net income of $US5.3 billion ($A5.8 billion) in the last three months of 2013, compared with a profit of $US5.7 billion in the same period a year earlier.

On a per-share basis, JPMorgan said it had earned $US1.30 a share in the quarter, compared with $US1.39 a share a year earlier.

Revenue fell one per cent to $US24.1 billion, just above analysts' expectations of $US23.9 billion.

The bank reported a loss in the third quarter, due to the bank's mounting legal costs. It was the bank's first quarterly loss in 10 years.

Firing squads proposed for US execution

A POLITICIAN in the US is proposing the use of firing squads to execute condemned inmates if constitutional problems or other issues ever prevent his state from using lethal injection.

Wyoming state Senator Bruce Burns, a Republican, said on Monday that state law currently calls for using a gas chamber if lethal injection is unavailable.

"The state of Wyoming doesn't have a gas chamber currently, an operating gas chamber, so the procedure and expense to build one would be impractical to me," said Burns, a member of the Senate Judiciary Committee.

"I consider frankly the gas chamber to be cruel and unusual, so I went with firing squad because they also have it in Utah," Burns said. He's introduced the bill for consideration in the legislative session that starts February 10.

"One of the reasons I chose firing squad as opposed to any other form of execution is because frankly it's one of the cheapest for the state," Burns said.

Burns said his bill addresses this issue because a number of states are running short of the chemicals used for lethal injection, largely because companies have stopped selling the drugs to prisons.

Wyoming, a sparsely populated western state, has only one inmate on death row and last executed an inmate in 1992.

Richard Dieter, executive director of the national Death Penalty Information Center, said on Monday he believes Wyoming could face constitutional challenges if it tried to use the firing squad as its only method of execution.

Dieter said Utah has offered inmates the choice of being executed by firing squad but said the state is phasing out the punishment.

Harris pleads not guilty to sex offences

AUSTRALIAN entertainer Rolf Harris has pleaded not guilty to 12 sex offences dating back to the 1960s.

Harris - dressed in a blue suit, white shirt and red tie - appeared in London's Southwark Crown Court on Tuesday for a plea and case management hearing ahead of his trial scheduled for April 30.

The 83-year-old, appearing relaxed and much healthier than his last court appearance in September, answered with a load and clear "not guilty" as each of the indecent assault charges were read to him in the packed courtroom.

Harris also remains charged with making four indecent images of a child in 2012. He is yet to be arraigned on those charges.

Harris was accompanied to the court in central London by a group of around a dozen friends and family including his elderly wife Alwen, whom he pushed in a wheelchair, and his middle-aged daughter Bindi.

He sat still and appeared relaxed in the dock during the hearing, which lasted more than an hour, speaking only briefly to confirm his name and enter his pleas.

The court heard Harris is accused of 12 separate counts of sexual assault, involving four alleged victims.

He was last year charged with six counts of indecently assaulting a 15-year-old girl in 1980 and 1981 and three charges of indecently assaulting a girl aged 14 in 1986.

Last month he was charged with a further three offences; one against a 19-year-old in 1984, one against a girl "aged seven or eight in 1968 or 1969" and another against a 14-year-old in 1975.

The count relating to the 19-year-old involved the same alleged victim as six of the earlier counts.

Harris was also previously charged with four counts of making indecent images of a child in the first half of 2012.

Tuesday was Harris' first appearance in court since a hearing at Westminster Magistrates' Court in September, when he looked frail and confused.

He is expected to attend at least two more hearings before his trial is scheduled to begin.

On Tuesday, Justice Nigel Sweeney renewed Harris' bail conditions, which dictate that he does not contact prosecution witness and lives at his home address in Bray.

Harris made no comment to reporters after the hearing as he walked past a huge media scrum held behind barricades at the front of the court.

Harris was questioned under caution in November 2012 by officers working on Operation Yewtree, the national investigation launched after abuse claims were made against Jimmy Savile.

He was then arrested in March, and charged in August. The allegations against Harris have no connection to Savile.

Harris has not commented on the allegations since he was first named in the press in April.

Harris, who painted a portrait of the Queen in 2005 and performed at her Diamond Jubilee concert last year, has been in the public eye for decades.

He had his first musical hit Tie Me Kangaroo Down, Sport in 1960, and continued to enjoy success in the industry as well as forging a television career.

Heatwave in southern Aust enters day two

AS the five-day heatwave in Australia's southern states enters its second day, it is expected to push health and emergency services to the limit.

Victoria and South Australia are tipped to endure the worst of the conditions, but NSW and Tasmania will also feel the hot air mass spreading from the west.

Adelaide continues its five consecutive days of temperatures above 40 degrees, with 42C forecast for Tuesday, 43C on Wednesday and Thursday and 40C on Friday before a cool change.

Melbourne is forecast to top 40C on Tuesday, Thursday and Friday, with 39C predicted for Wednesday.

Victorian Fire Service Commissioner Craig Lapsley says the heatwave will bake Victoria's bush and grassland, creating perfect bushfire conditions.

Ambulance Victoria manager of emergency management Paul Holman described this week's conditions as the worst heatwave since the lead-up to the 2009 Black Saturday fires.

During Victoria's 2009 heatwave 370 people died from heat-related illnesses and there was a 46 per cent increase in calls to triple zero in three days.

South Australian Premier Jay Weatherill has urged all people to take care of those most vulnerable to the heat, including elderly relatives, friends and neighbours.

He says people without air-conditioning at home should consider heading to cooler public facilities such as cinemas, shopping centres and libraries.

Sydney will be spared the worst of the weather, with temperatures in the high 20s in the city and high 30s in the city's west.

A total fire ban has been declared for southern Tasmania on Tuesday and parts of the state's south will reach the mid to high 30s during the next few days.

After a weekend of extreme heat that triggered bushfires, Perth will experience a mild week before temperatures hit the high 30s at the weekend.

Shots fired into southern Sydney home

SEVERAL shots have been fired into an empty home in Sydney's south.

The latest shooting happened shortly before 10pm (AEDT) on Monday, at a residence on The Kingsway at Woolooware.

Several bullet holes have been discovered in the front of the home and police say a crime scene has been established.

Detectives and forensic police are conducting further inquiries.

Six-year-old boy clipped by car in Sydney

A SIX-YEAR-OLD boy has been hit by a car after it veered off the road and mounted a footpath in Sydney's west.

Police say a P-plater was driving when the child was clipped by the car, but the boy luckily walked away with only cuts and bruises.

The accident happened as the driver turned from Railway Terrace at Merrylands into Merrylands Road on Monday evening.

"The car has left the road, mounted the footpath and clipped a six-year-old boy," a police statement said on Tuesday.

The boy suffered only minor injuries and was treated by paramedics before being taken to hospital for precautionary medical checks.

An 18-year-old man was breath-tested at the scene and returned a negative result.

Forty arrested after Spain street riots

SPANISH officials say riots in the northern city of Burgos have left 11 police injured and led to the arrest of 40 people after protesters began attacking police vehicles, burning rubbish containers and breaking windows.

Rioting began on Friday night as residents of Burgos' Gamonal district objected to city hall plans to remodel a street into a tree-lined boulevard with an underground car park.

Eight police were injured and 17 people arrested.

A government statement said disturbances erupted again on Saturday, with locals demanding the release of those arrested the previous night, leading to three police being injured and 23 further arrests.

The Sunday statement said police intervened to "guarantee law and order and citizens' safety".

NSW man charged after alleged hit and run

A MAN has been charged following an alleged hit and run incident in central NSW.

A 19-year-old man was with a group of friends when he was crossing the road about 1am (AEDT) on Saturday at Narromine, about 40 kilometres west of Dubbo, when he was struck by a car, police said.

He was taken to Dubbo Base Hospital, before being transported to Westmead Hospital in Sydney, where he remains in a critical but stable condition.

Police allege the driver did not stop after the accident.

A 57-year-old Warren man was arrested at a property west of Narromine on Sunday night and later charged with dangerous driving causing grievous bodily harm and failing to stop and assist after an impact.

He was given conditional bail to appear at Narromine Local Court on February 11.

Thai protesters set to shut down Bangkok

ANTI-GOVERNMENT demonstrators are preparing to occupy major intersections of Thailand's congested capital in what they say is an effort to shut down Bangkok.

The plan has raised fears of violence that could trigger a military coup.

The protesters are trying to force caretaker Prime Minister Yingluck Shinawatra to resign and have her government replaced by a non-elected interim administration to implement reforms they say are needed to stop corruption and money politics.

They want to scuttle an early general election called by Yingluck for February 2.

Since November, the demonstrators have engaged in street battles with police, cut off water and electricity to police headquarters and occupied for a time the compounds of other government agencies.

At least eight people, including a policeman, have died in violence associated with the political unrest.

The protest leaders said last week that the demonstrators would occupy seven key intersections on Monday in Bangkok, a teeming city known for its debilitating traffic jams.

They are also threatening to occupy government office compounds.

Groups of demonstrators started arriving late on Sunday at some of the venues, where they said they would erect stages.

Earlier on Sunday, some demonstrators blocked a road in Bangkok's northern outskirts, where many government offices are located, said Deputy Police Spokesman Colonel Anucha Romyanan.

There were no immediate confrontations with the authorities, who have vowed to show restraint in order to avoid violence.

Deputy Prime Minister Surapong Tovichakchaikul said on Friday that a combined force of around 12,000 police officers and 8000 soldiers was being deployed to maintain order in the capital.

Protest leaders have said they will maintain their "shutdown" of Bangkok for weeks, or until they obtain their goal.

Their recent demonstrations have drawn up to 150,000-200,000 people at their height.

Concern about a coup is high because of the army's history of intervening in politics.

Army commander General Prayuth Chan-ocha has refused to rule out the possibility of a military takeover.

Another deputy prime minister, Pongthep Thepkanjana, said on Friday that be believed the army had learned a lesson from the 2006 coup - which ended up polarising Thailand rather than pacifying it - and that the international community and many Thais would be opposed to a military takeover.

One dead, 27 homes lost in Perth bushfire

A MAN has died attempting to save his house from a devastating bushfire in the Perth hills that has destroyed at least 27 homes.

St John Ambulance staff say the man collapsed on the roof of his house in Hovea just after noon on Sunday.

St John crews were unable to access the roof despite assistance from the Department of Fire and Emergency Services (DFES), and the man died at the scene.

Despite the efforts of dozens of firefighters and helitac helicopters in atrocious conditions, properties near Parkerville and Stoneville were razed by the fast-moving fire.

One Chidlow resident said he was leaving most of his possessions to the flames.

"There are embers coming down like an ash - we are getting the hell out of here," he told ABC radio.

"We are taking the animals, some clothes and the tax files in a box and we are leaving everything else. If it burns, it doesn't matter."

The DFES confirmed 27 homes had been lost, and added this number was expected to increase as damage assessments continued into Monday.

More than 100 firefighters and 50 vehicles remained on the scene late on Sunday, as warnings in the area were downgraded to watch-and-act, and waterbombers were deployed to battle the blaze.

Burning embers were being blown around homes, and spot fires were starting up to 150 metres ahead of the fire, the DFES said.

At least two firefighters have been treated for heat exhaustion.

Just before noon on Sunday, residents in the eastern part of Mundaring were told to leave their homes immediately.

Less than 30 minutes later, locals were told it was too late to leave, as it could be deadly if they did.

By 4pm WST, more than 250 hectares had been burnt.

An emergency warning was issued for people after the fire started between Johnson Road and Granite Road at 11am. The cause of the blaze is not yet known.

Flames up to 20 metres high burned towards Richardson Road, Riley Road and Stoneville Road and residents were warned they were in danger and needed to act immediately to survive.

Homes east of Parkerville were in the immediate path of the fire, and emergency authorities confirmed several houses had been destroyed.

Two separate evacuation centres were established, with the Mundaring Recreation Centre filling up with more than 80 evacuees, with a second evacuation centre set up at Brown Park in nearby Swan View.

Mundaring shire president Helen Dullard said they were setting up to have people staying in emergency conditions for days, with Salvation Army volunteers on hand.

"We have got food and accommodation well taken care of, and there will be people staying overnight and not just one night," Ms Dullard said.

"But we are still in an emergency stage.

"Some are finding out by friends, and because their friends' houses have gone, then theirs has gone. Some aren't sure.

"They are anxious to get home as soon as they can, but are having to wait and that is very difficult for them."

The blaze in the hills were the worst of a horror day for WA fire authorities, who battled blazes in Wanneroo, Boddington, Denmark, Gosnells, Shark Bay and a major fire in Baldivis.

The fires came after two successive days of 40C heat in Perth, and an oppressive heatwave in the northern part of the state all week.

Short odds for Blanchett Golden Globe win

CATE Blanchett is the red hot favourite to take home the Golden Globe, despite competing against the elite Hollywood quartet of Sandra Bullock, Judi Dench, Kate Winslet and Emma Thompson.

Bookmakers have Blanchett at short-priced odds of 1/8 to win the dramatic actress Globe at Sunday's (Monday AEDT) star-studded award ceremony at the Beverly Hilton Hotel.

The Globes are one of the big indicators of who will win the Oscar at the March 2 Academy Awards.

Blanchett is nominated for her role in Woody Allen's drama-comedy Blue Jasmine.

The Australian actress plays a wealthy New York socialite who, when her husband is arrested, suddenly finds herself broke, disgraced and forced to live with her working-class sister in San Francisco.

Bullock, for Gravity, is Blanchett's closest rival at odds of 6/1 while Thompson, who plays Australian Mary Poppins author PL Travers in Saving Mr Banks, is third at 25/1, Dench (Philomena) is 33/1 and Winslet (Labor Day) is the 100/1 longshot.

In other Globe award categories, 12 Years a Slave is the favourite for dramatic picture, American Hustle is expected to win the comedy/musical award and Gravity's Alfonso Cuaron is the bookmakers' pick to take the directing gong.

In TV categories, the recently departed Breaking Bad is the favourite for best TV drama series and its star Bryan Cranston is the frontrunner to go out on top with the lead actor Globe.

The Globes are scheduled to begin 12.30pm AEDT on Monday.
